Living Wills: The Right to a Peaceful End of Life

About the article

Under Section 12 of Thailand's National Health Act of 2007, people may make a written declaration refusing treatment that only prolongs dying: a 'living will'. This is different from euthanasia, which is not legal in Thailand. Figures from the National Health Commission Office show that online living wills have risen more than tenfold to nearly 100,000. Most are made by women over 60, and Nakhon Ratchasima has the most. Officials say people of all ages are now planning for the end of life. A caregiver describes how her parents declined CPR and ventilators and died peacefully at home.

Reading passage

Many people may never have thought that they can decide in advance how they are cared for at the end of their life. Under Section 12 of the National Health Act B.E. 2550 (2007), a person has the right to make a written declaration refusing treatment that merely prolongs dying. This document is commonly called a "living will".

A living will is completely different from euthanasia. The person making it does not ask doctors to hasten their death; they only ask that machines not be used to prolong life once there is no way to cure them. Note that Thailand still has no law permitting euthanasia.

Data from the National Health Commission Office (NHCO) shows the number of people making living wills online has risen more than tenfold, to nearly one hundred thousand. Most of those making them are women over 60, followed by women aged 45–59. The province with the most is Nakhon Ratchasima, followed by Sukhothai and Nakhon Si Thammarat.

The NHCO's deputy secretary-general believes Thais understand this matter better now, and people of all ages are starting to plan for the last stage of life. Preparing in advance helps not only the patient but also relieves their children of difficult decisions. Those not yet ready to make a formal document can start by recording their wishes in a planning booklet called "Samut Bao Jai".

One 64-year-old caregiver recounted that her parents had made it clear they did not want CPR or a ventilator. In the end, both of them passed away peacefully at home. This story shows that a good death is a right everyone should have respected.
